Terms of Use

1. Acceptance of These Terms

These Terms of Use (the Terms) govern your access to and use of the websites that Philadelphia College of Osteopathic Medicine (PCOM, we, us, or our) owns and operates under the pcom.edu domain (the Sites). By accessing or using the Sites, you agree to these Terms. If you do not agree, please exit the sites and do not use the Sites.

2. Scope and Properties Not Covered

These Terms apply only to the Sites that PCOM owns and controls. They do not govern, and PCOM is not responsible for:

  • Websites operated by separate legal entities, which are governed by their own terms.
  • Third-party websites and applications, including stores, payment pages, learning platforms, non-PCOM giving or donation platforms, or other services that may be accessed through links or embedded features on PCOM websites that are not affiliated/owned by PCOM. Such third-party services are governed by the vendor's own terms and privacy practices.
  • External websites, resources, and listings that PCOM links to or displays but does not control.

3. Use of the Sites

You may use the Sites for lawful purposes only. You agree not to:

  • Use the Sites in any way that violates applicable law or regulation.
  • Attempt to gain unauthorized access to any portion of the Sites, accounts, systems, or networks.
  • Interfere with or disrupt the Sites, including through automated scraping, denial of service activity, or the introduction of malicious code.
  • Misrepresent your identity or affiliation, or use the Sites to harass, defame, or harm others.
  • Collect, manipulate, copy or harvest personal information of other users.

4. Accounts and Authenticated Areas

Certain areas of the Sites, including the myPCOM portal, require you to log in with credentials issued or approved by PCOM. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify PCOM promptly of any unauthorized use. Access to authenticated areas is also subject to PCOM's institutional policies, which apply in addition to these Terms.

5. Intellectual Property

Unless otherwise noted, the content on all PCOM or PCOM-affiliated Sites, including text, graphics, logos, images, and software, is owned by or licensed to PCOM and is protected by intellectual property laws. PCOM grants you a limited, nonexclusive, nontransferable, revocable license to access and use the Sites for noncommercial, and institutional purposes. You may not reproduce, distribute, modify, or create derivative works from the content without prior written permission by authorized PCOM representatives, except as permitted by law. PCOM names, logos, and marks may not be used without prior, written authorization by the Chief Marketing and Communications Officer or designee.

If you believe any material infringes upon a copyright or other intellectual property rights, contact webteam@pcom.edu and provide as much identifying information as possible (including a link to the material in question) as well as your contact information. Any information that PCOM determines violates any third party's copyright or other intellectual property protection is subject to immediate removal without notice in the sole discretion of PCOM.

6. Third Party Content, Links, and Job Postings

The Sites may display or link to content that PCOM does not author or control, including external links, embedded media, and job or position listings supplied by third parties. PCOM provides this content for convenience and does not endorse, guarantee, or assume responsibility or liability for it. Your use of third party content and websites is at your own risk and may be governed by the third party's own terms and privacy practices. Job and position listings are the responsibility of the party that supplies them, and PCOM does not guarantee their accuracy, availability, or legitimacy.

7. User Submitted Content

If the Sites allow you to submit content, such as forms, comments, or uploads, you are responsible for what you submit and you represent that you have the right to submit it. You grant PCOM a nonexclusive, royalty free license to use that content for the purpose for which it was submitted and to operate the Sites. PCOM may remove user submitted content at its discretion.

8. Privacy

Your use of the Sites is also governed by the PCOM Privacy Policy, which describes how we collect and handle information. Please review it before using the Sites.

9. Accessibility

PCOM is committed to digital accessibility. Please refer to our Website Accessibility Statement for our conformance posture and for how to request assistance or report a barrier.

10. Disclaimers

The Sites and their content are provided on an as is and as available basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement. PCOM does not warrant that the Sites will be uninterrupted, secure, or error free, or that content is accurate, complete, or current.

Content on the Sites is provided for general informational and educational purposes only. It is not professional, legal, financial, or medical advice, and it does not create a provider and patient or other professional relationship. Site content is not a substitute for professional care or for consultation with a qualified professional.

11. Limitation of Liability

To the fullest extent permitted by law, PCOM and its trustees, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or related to your use of or inability to use the Sites, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless PCOM and its trustees, officers, employees, and agents from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising out of your use, misuse (either negligent or punitive) of the Sites or your violation of these Terms.

13. Changes to the Sites and to These Terms

PCOM may modify, suspend, or discontinue any part of the Sites at any time. PCOM, in its sole discretion, may at any time revise the Terms from time to time - with any or no notice.. Changes are effective when posted, and your continued use of the Sites after changes are posted constitutes acceptance of the revised Terms. We will update the effective date when we make changes.

14. Suspension and Termination of Access

PCOM may restrict, suspend, or terminate your access to the Sites or authenticated areas at any time, with or without notice, for conduct that violates these Terms or applicable policy, or to protect the Sites and their users.

15. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. You agree that any dispute arising out of or related to these Terms or the Sites will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.

16. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect. PCOM's failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy and any policies referenced here, are the entire agreement between you and PCOM regarding the Sites.
